1. Who we are.
This Privacy Policy explains how Sierra Energy Corporation, as operator of TechPipe ("TechPipe," "we," "us," or "our"), collects, uses, discloses, and protects personal information when you visit or use TechPipe, respond to our communications, submit information to us, or express interest in territorial distribution opportunities or distribution-related rights involving FastOx® gasification technology. For personal information covered by this Policy, Sierra Energy Corporation is the business or controller. Our vendors and service providers process personal information for us as described below.
2. Scope.
This Policy applies to TechPipe, including our website, outreach, bidding, referral, diligence, demand-generation, and prospective-business-development activities. TechPipe is a website and platform for potential territorial distribution opportunities and distribution-related rights under definitive agreements. It is not a platform for selling FastOx gasification systems, Sierra Energy services, FastOx gasification technology licenses, operating rights, franchises, dealerships, commercial agencies, or authority to bind Sierra Energy Corporation. This Policy does not govern third-party websites, platforms, services, or content that we do not control, except to the extent this Policy describes our own collection, use, or disclosure of personal information in connection with those services.
3. Information we collect.
- Business contact information: name; company or entity name; title or role; business email; business phone; mailing address; and similar information you provide or that is available from business-contact, referral, or public sources.
- Prospective participant and interest information: territories or opportunities of interest; indications of bidding, territory-interest, referral, diligence, or distribution interest; and comments, inquiries, or other information you choose to submit.
- Communications and engagement information: records of outreach campaign sends, email opens and clicks where enabled, website page visits, form submissions, bidding or referral activity, meeting requests, inquiries, and related activity maintained in our contact-management or customer-relationship-management systems.
- Device, log, and analytics information: IP address, approximate location derived from IP address, device and browser information, pages viewed, referring URLs, cookie or similar-technology identifiers, and related website usage information.
Diligence and compliance information: information reasonably relevant to evaluating prospective territorial distribution opportunities, distribution-related rights, referrals, bidding activity, definitive agreements, or other prospective business relationships; verifying authority to act for an organization; conducting sanctions, export-control, anti-corruption, fraud-prevention, or other compliance screening; and protecting our rights, website, platform, and operations. We collect personal information directly from you, automatically through our website and related technologies, from communications with you, and, where appropriate, from business-contact databases, referrals, affiliates, service providers, publicly available sources, and other sources used for lawful outreach and diligence.
4. How we use information.
- To contact you about TechPipe and territorial distribution opportunities or distribution-related rights involving FastOx gasification technology.
- To gauge and validate demand across territories, regions, market segments, and prospective territorial distribution opportunities.
- To send outreach campaigns, updates, event or meeting information, and, where applicable, SMS or similar messages, and to notify you when a territorial distribution opportunity, bidding process, referral opportunity, diligence process, or related opportunity of interest may become available.
- To maintain and improve our CRM and related systems, understand engagement, personalize or measure outreach, support bidding, referral, and diligence activity, and improve our website, platform, and communications.
- To conduct diligence and compliance screening, protect against misuse or unlawful activity, comply with applicable legal obligations, respond to lawful requests, and enforce our website terms and other rights.
Where applicable law requires a legal basis for processing, we rely on one or more appropriate bases, which may include our legitimate interests in business development, demand validation, website operation, security, and relationship management; your consent where required, such as for certain marketing communications or cookies; performance of pre-contractual or contractual steps; and compliance with legal obligations.
5. How we share information.
- Vendors and service providers, including Infinity Constellation Inc. d/b/a Supernal where engaged by Sierra Energy Corporation, and website, hosting, analytics, CRM, email, communications, diligence, security, and professional-services providers, to support TechPipe, our outreach, our website, and our business operations. These parties act as service providers or processors where they process personal information on our behalf and under our instructions.
- Marketing, email, analytics, and advertising platforms used to deliver, personalize, and measure campaigns, subject to applicable law and available opt-out choices.
- Sierra Energy, relevant affiliates, prospective transaction counterparties, and advisers, where appropriate for business development, diligence, corporate transactions, legal compliance, or protection of rights.
6. Marketing communications and your choices.
You may opt out of marketing emails by using the unsubscribe link in our messages or by contacting us as described in Section 12. If we send SMS or similar messages, you may opt out as described in those messages. We will honor opt-out requests as required by applicable law, but we may continue to send non-marketing communications, such as responses to your inquiries or notices relating to an existing or prospective business relationship.
7. Cookies, tracking, and privacy choices.
We use cookies, pixels, analytics tools, and similar technologies to operate and secure the website; maintain account sessions; authenticate users; support territory-interest and bidding functionality; record auction activity; remember privacy choices; prevent fraud or abuse; and comply with legal obligations. These necessary technologies cannot be disabled through the cookie-preference tool. We may use optional cookies or similar technologies for analytics, site improvement, personalization, marketing, targeted advertising, or similar purposes only with your consent or subject to any legally required opt-out choices. Where applicable law provides opt-out rights for sale, sharing, or targeted advertising, you may exercise those rights through Your Privacy Choices. We will honor legally required opt-out preference signals, including Global Privacy Control where required, for the browser or device and associated profile to the extent required by law. Rejecting optional cookies or opting out of sale, sharing, or targeted advertising will not, by itself, prevent account, territory-interest, auction, or bidding functionality. Blocking necessary technologies may prevent some features from functioning properly.
8. Data retention.
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including outreach, demand-generation, relationship management, diligence, security, legal compliance, dispute resolution, and recordkeeping. Retention periods may vary based on the type of information, our relationship with you, applicable legal requirements, and operational needs. When information is no longer needed, we take reasonable steps to delete, de-identify, or otherwise handle it in accordance with applicable law and our records practices.
9. Security.
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, which may include access controls, logging, and encryption in transit where appropriate. No website, system, transmission, or storage method is completely secure, and we cannot guarantee absolute security.
10. Your privacy rights.
Depending on your location and subject to applicable limitations, you may have privacy rights such as the right to request access to, correction of, deletion of, or portability of personal information; to object to or restrict certain processing; to withdraw consent where processing is based on consent; and to opt out of certain targeted advertising, sale, sharing, profiling, or marketing communications. U.S. state privacy laws, including California's privacy law, may provide additional rights for eligible residents. International users, including users in the European Economic Area, the United Kingdom, Switzerland, Canada, and other jurisdictions, may have similar or additional rights under applicable law. If you access our website or communicate with us from outside the United States, your personal information may be processed in the United States and other countries where we or our service providers operate, which may have privacy laws different from those in your jurisdiction. To exercise a privacy right or submit a privacy request, please contact us as described in Section 12. We may need to verify your identity and authority before responding, and we will respond as required by applicable law. Exercising a privacy right will not result in unlawful discrimination, but some requests may affect our ability to provide requested information, communications, or website functionality.
11. Children.
Our website and platform are intended for business users and individuals who are at least 18 years old. We do not knowingly collect personal information from children or use TechPipe for child-directed activities.
12. Changes and contact us.
We may update this Policy from time to time to reflect changes in our practices, website or platform functionality, legal requirements, or business needs. If we make material changes, we will post the updated Policy with a new "Last updated" date and provide additional notice where required by law.
